Regional Court in Düsseldorf Germany Fines Importer $14,063 for Trademark Infringement
On or about October 23, 2013, German Customs seized 3,000 microSD memory card and adapter sets being imported into the town of Essen by a local citizen. SD-3C LLC ("SD-3C") then filed a complaint against the individual for trademark infringement.
According to the final decision rendered on October 15, 2014 by the Regional Court of Düsseldorf, the individual was found guilty of infringing SD-3C's intellectual property rights. As a result, the individual was fined and required to reimburse SD-3C $14,063 (approximately €11,083) for damages.
Further, the Customs Office confiscated the counterfeit microSD memory cards for destruction.
